Welcome to Menopause Better ("the App"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Menopause Better App Ltd ("Company," "we," "us," or "our") regarding your use of the Menopause Better mobile application and related services.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

Acceptance of Terms

By accessing or using Menopause Better, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

Eligibility

You must be at least 18 years old to use this App.

By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Medical Disclaimer

NOT MEDICAL ADVICE: The App is designed for informational and tracking purposes only. The content provided through Menopause Better, including but not limited to symptom tracking, educational materials, and wellness suggestions, is NOT intended to be a substitute for professional medical advice, diagnosis, or treatment.

CONSULT YOUR HEALTHCARE PROVIDER: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked in the App.

EMERGENCY SITUATIONS: If you think you may have a medical emergency, call your doctor or emergency services immediately. The App does not provide emergency medical services.

NO DOCTOR-PATIENT RELATIONSHIP: Use of the App does not create a doctor-patient relationship between you and the Company or any healthcare provider.

Menopause Better provides features including, but not limited to:

Symptom tracking and monitoring

Educational content about menopause

Wellness tips and lifestyle recommendations

User Account and Registration

You may be required to create an account to access certain features of the App. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account or any other breach of security.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You acknowledge that you provide your personal health information at your own risk.

User Responsibilities and Prohibited Conduct

You agree NOT to:

Use the App for any unlawful purpose or in violation of these Terms

Attempt to gain unauthorised access to any portion of the App or any systems or networks connected to the App

Interfere with or disrupt the App or servers or networks connected to the App

Use any robot, spider, scraper, or other automated means to access the App

Reverse engineer, decompile, or disassemble any portion of the App

Share your account credentials with others or allow others to access your account

Upload or transmit viruses or any other malicious code

Intellectual Property Rights

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Menopause Better App Ltd or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes only.

You retain ownership of any personal data you input into the App, while granting us a license to use such data to provide and improve our services as described in our Privacy Policy.

Subscription and Payment Terms

Menopause Better may offer both free and premium subscription tiers. Premium features require payment of applicable subscription fees.

Subscription fees are billed in advance on a monthly/annual basis and are non-refundable except as required by law.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

You may cancel your subscription at any time through your account settings or the app store through which you purchased the subscription.

We reserve the right to change subscription fees with reasonable notice. Changes will not affect your current subscription period.

Third-Party Services and Links

The App may contain links to third-party websites, services, or resources. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites or services.

Your use of third-party services is at your own risk and subject to their terms and conditions.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, OR LINKS PROVIDED THROUGH THE APP.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Menopause Better App Ltd, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: 40.1.Your use or inability to use the App 40.2.Any unauthorized access to or use of your personal information 40.3.Any interruption or cessation of the App 40.4.Any bugs, viruses, or other harmful code transmitted through the App 40.5.Any errors or omissions in content or any loss or damage incurred as a result of your use of any content posted or transmitted through the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Menopause Better App Ltd, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from: 42.1.Your use of the App 42.2.Your violation of these Terms 42.3.Your violation of any rights of another person or entity

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, effective immediately.

You may terminate your account at any time by discontinuing use of the App and deleting it from your device.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be resolved through arbitration/mediation/court litigation in United Kingdom.

You agree that any claim or dispute must be brought within one (1) year after the cause of action arises, or such claim or dispute will be permanently barred.

Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice.

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Menopause Better App Ltd regarding the use of the App and supersede all prior agreements and understandings.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
